TERMS & CONDITIONS

These Terms & Conditions apply to all website, web application, domain, hosting, maintenance and online services provided by Webmasters Ghana (“Webmasters”, “we”, “us” or “our”) to the Client (“you” or “your”).
1. ACCEPTANCE OF THESE TERMS
By engaging with, purchasing from, requesting services from, providing instructions to, making payment to, accessing services provided by, or otherwise dealing with Webmasters Ghana, whether expressly, impliedly, electronically, verbally or by conduct, the Client acknowledges and agrees to these Terms & Conditions.
This includes approving a quotation, making a payment, sending instructions, providing content or access, or asking Webmasters Ghana to begin or continue work.
Continuing to deal with Webmasters Ghana constitutes acceptance of these Terms & Conditions.
2. PROJECT SCOPE & CHANGES
Webmasters Ghana will provide only the services, features and deliverables specifically stated in the approved quotation, proposal, invoice or project agreement.
Any additional feature, page, integration, redesign, modification or request outside the agreed scope may attract an additional fee.
Anything not specifically included in the agreed scope is not considered part of the Project.
3. PAYMENT
A deposit or agreed initial payment may be required before work begins.
The Client agrees to pay all fees according to the agreed payment schedule.
Webmasters Ghana may pause development, support, hosting, deployment or delivery where payments are overdue.
Final files, administrative access, deployment or transfer of services may be withheld until outstanding amounts are paid.
Payments for completed work and third-party services already purchased or incurred are generally non-refundable, unless otherwise agreed in writing.
4. DOMAIN NAMES, HOSTING & NAMESERVERS
Domain names and hosting are separate services and may require recurring renewal fees.
Where Webmasters Ghana registers or manages a domain for the Client, the Client is responsible for providing accurate registrant information and paying applicable renewal fees.
Webmasters Ghana is not responsible for domain loss, suspension or expiration caused by non-payment, incorrect information, registrar or registry action, or failure to complete required verification.
Where Webmasters Ghana manages hosting, nameservers or DNS, the service is limited to the agreed hosting package.
If the Client or a third party changes nameservers, DNS, hosting settings or other technical configurations, Webmasters Ghana is not responsible for resulting disruption or damage.
5. CLIENT ACCESS & RESPONSIBILITY
The Client may have access to domains, hosting, websites, web applications, email accounts, payment platforms and other online services.
Access to these services does not make Webmasters Ghana responsible for actions or changes made by the Client or anyone the Client gives access to.
The Client is responsible for keeping passwords, account credentials and payment information secure.
The Client is also responsible for providing accurate information, content, approvals and materials required for the Project.
6. THIRD-PARTY SERVICES
Websites and web applications may depend on third-party platforms and services, including hosting providers, domain registrars, payment gateways, Google services, social media platforms, plugins, APIs, email providers, software licences and other online services.
These services are controlled by their respective providers.
Webmasters Ghana cannot guarantee the availability, pricing, security, policies, features or continued operation of third-party services.
Any third-party subscription, renewal, transaction, usage or licence fees are the Client’s responsibility unless specifically included in the agreed quotation.
7. PAYMENTS, FRAUD & UNLAWFUL USE
Where the Client provides a credit card, debit card, bank account, mobile money account or other payment method, the Client confirms that they are authorised to use it.
The Client must not use any Webmasters Ghana service for fraud, phishing, scams, hacking, illegal transactions or any other unlawful or malicious activity.
The Client is fully responsible for all activities, transactions, content and actions carried out through any account, website, domain, hosting service or web application under the Client’s control.
Webmasters Ghana may suspend or terminate services where fraudulent, unlawful or abusive activity is suspected.
8. CONTENT, DATA & LEGAL RESPONSIBILITY
The Client is responsible for all text, images, videos, logos, products, prices, customer information and other materials supplied to Webmasters Ghana.
The Client confirms that they have the necessary rights and permissions to use such materials.
The Client is responsible for ensuring that their business, website, products, services, content and collection or use of customer information comply with applicable laws and regulations.
Webmasters Ghana provides technical and digital services and does not provide legal, tax, financial or regulatory advice unless separately agreed.
9. SECURITY, BACKUPS & BUSINESS RESULTS
Webmasters Ghana will use reasonable efforts to maintain the security and functionality of the services provided.
However, no website, web application, hosting environment or online account can be guaranteed to be completely secure, uninterrupted or free from technical failures, hacking or data loss.
Where backups are included, Webmasters Ghana will make reasonable efforts to maintain them. Clients should maintain their own copies of important information and data.
Webmasters Ghana does not guarantee specific Google rankings, website traffic, sales, leads, revenue, conversions or other business results unless expressly agreed in writing.
10. CANCELLATION, LIABILITY & GOVERNING LAW
If the Client cancels a Project after work has commenced, the Client remains responsible for work already completed and third-party costs already incurred.
To the maximum extent permitted by law, Webmasters Ghana shall not be responsible for indirect or consequential losses, including lost profits, lost sales, lost customers, downtime, data loss or losses caused by third-party services, Client actions or circumstances outside Webmasters Ghana’s reasonable control.
These Terms shall be governed by the laws of the Republic of Ghana, unless Webmasters Ghana and the Client expressly agree otherwise in writing.
Any dispute should first be addressed between Webmasters Ghana and the Client in good faith before further legal action is taken.
